What is mediation?

Mediation is a process where an independent person works with an employer and an individual employee, or group or employees, who are having some form of disagreement or problem in the workplace.

A mediator is not there to decide who’s right and wrong, but to work with both sides to come to a positive solution for moving forward.

It’s a confidential and voluntary process, it’s less stressful than using formal procedures or the courts, and it’s very good early in a problem situation to make sure things are kept on track and that the employment relationship continues or can be ended amicably.

It also saves an employer the cost of taking the issue further and the employee has the opportunity to put things behind them and move forward in the workplace if the relationship is to continue.
 

What is mediation suitable for?

It’s suitable for all sorts of issues, such as performance, attendance, personality clashes and employee grievances, as well as individual rights issues around matters like redundancy, dismissal and discrimination.



How does it work?

Not all issues may be ripe for mediation, so initially JIB Mediation Services will help you to explore if your particular issue is one that’s suitable for mediation. If it is, we have a team of experienced mediators who can work with you to generate a way forward.

It’s a process that’s fully involving of both parties and it’s your solution, not the mediator’s – the mediator is there to help develop a solution not to give you the answer.

Meetings are arranged and conducted at a suitable convenient location, (e.g. your office or a hotel) and issues are discussed in a structured but informal manner. The mediator will then consider the case and help each party discuss a range of solutions that may help the issue.

In some cases an action plan or agreement is drawn up, to help both sides progress beyond the mediation session.
